U.S. Customs and Border Protection (CBP) modernization has arrived with a proposed list of changes to Customs Brokers Regulation (19CFR Part 111) restructure on certain fundamentals of the business.
 
This webinar will outline the background, general administrative changes, substantive changes, impact on broker’s customs business, relation with broker’s importing clients and CBP including Q&A session.

Biography

Since his admission to the bar in 1973, Elon Pollack practices exclusively in the area of customs law and related trade matters. Prior to1980, Mr. Pollack was an Assistant Regional Counsel for Customs in New Orleans, and later as a senior attorney in Customs Headquarters. 

Beginning in 1974, Mr. Pollack lectured on import and export procedures. In 1986, Mr. Pollack taught at the UCLA Extension, “Importing and Exporting Wearing Apparel”.  Starting in 1997, Mr. Pollack teaches a class on Customs brokers and importing procedures at California State Long Beach in the Global Logistics Specialist, program. He received the George Marshal Instructor (of the Year) Award. 

In June 2001, Mr. Pollack spoke at of the Center for International Legal Studies in Salzburg, Austria on the topic of “United States Government Protection of Intellectual Property Rights.” Mr. Pollack has qualified and testified in federal and state court proceedings as an expert witness on Customs law.

In 2005, Mr. Pollack merged his law practice with Stein Shostak Shostak & O'Hara. As managing partner, he guided the firm to open its representative office in Shanghai, China in 2006. In China, Mr. Pollack has lectured to various groups including the Shanghai Freight Forwarders Association on importing into the United States. 

Beginning in 1987, Mr. Pollack appeared before the U.S. Court of International Trade and for almost ten years, he served on its Advisory Committee.

Mr. Pollack served as both the Vice Chair and Chair of the Customs Law Committee of the Los Angeles County bar.

During his career, Mr. Pollack has handled numerous and wide ranging Customs related cases: In 1993, he successfully challenged Customs' summons authority. That decision requires Customs to demonstrate the records it seeks pertain to Customs' transactions. Also, in 1998, Mr. Pollack successfully defended a licensed customs broker in a broker’s license revocation proceeding. In 2000, he successfully challenged Customs' laboratory procedures and Customs is now required to demonstrate that its laboratory tests are scientifically reliable. In 2006, he successfully challenged the imposition of civil penalties under the counterfeiting statute. Now, Customs must meet traditional standards of trademark infringement to impose penalties.                  

He is admitted to the bar in Virginia, Louisiana and California as well as several federal district courts, and courts of appeal, and the U.S. Court of International Trade.
